Long-Term and Permanent Injuries

Helping injured workers throughout New Jersey

Unfortunately, in some workplace accidents, workers are left with long-term or permanent injuries. These workers are eligible for permanent disability benefits in the workers' compensation system. But getting these benefits can be a difficult process. The New Jersey workers' compensation attorneys at the Law Offices of Adam M. Kotlar, LLC can help.

Workers in New Jersey who have suffered long-term or permanent work injuries are eligible for two types of benefits:

  • Permanent partial benefits-The worker may be able to work again but has suffered a disability in one or more parts of the body. Benefits are based on losses categorized as "scheduled" (a loss involving the arms, hands, fingers, legs, feet, toes, eyes, ears or teeth) or "non-scheduled" (a loss involving other parts of the body, such as the back, heart and lungs).
  • Permanent total benefits-The injury has left the worker unable to return to any type of job. Weekly benefits are provided for 450 weeks and may be extended after that.

As with other types of workers' compensation benefits, employer and insurance companies can challenge claims for permanent disability benefits. For example, the doctor they chose to treat your injury may question the severity of your injury. The insurance company may claim you are still able to work.
