Who Pays For Auto Accidents in New Jersey?

There is a "no fault" car insurance system in New Jersey. In general, this means that whoever was at fault for the accident, you would first file a claim for benefits with your own insurance company. Most drivers in New Jersey are required to carry Personal Injury Protection (PIP) on their policy. This pays for the medical expenses to treat the injuries you suffered in the accident, up to the amount of your coverage.

The minimum liability limits for other coverage in a standard auto insurance policy are:

  • $15,000 per person for bodily injury
  • $30,000 per accident for bodily injury (two or more people)
  • $5,000 per accident for property damage.

You then have options concerning your right to sue for other damages. In 1998, New Jersey passed the Automobile Cost Reduction Act (AICRA), designed to limit the amount of money victims could seek for pain and suffering after an accident.

If you select the "Limitation on Lawsuit" option - also known as a "verbal threshold" - you may pay less for insurance, but there are limits to how much money you can get for certain damages (other than medical expenses and lost wages), and you agree not file a lawsuit. But there are exemptions for death, dismemberment, displaced fractures, the loss of a fetus, permanent injuries and significant scarring or disfigurement.

If you choose the "No Limitation on Lawsuit" option, you may pay more for insurance, but you retain your right to sue the other driver.
