Slip and Fall/Premises Liability

In order to recover for personal injury damages as a result of a slip, trip or fall, it is necessary that there be some sort of a defective or dangerous condition at the location of the fall. It is not simply enough that an injury occurred or that a claimant fell. Rather, there must be an establishment that there was a specific duty of the property owner or occupier to maintain a safe environment and that duty was breached causing a valid claim for negligence cause of action. It is therefore essential for all people who are injured in a slip, trip or fall accident to promptly identify what the dangerous or defective condition on the property was which caused the fall.

The appropriate standard of care which would be attributable to the property owner or occupier depends in large part upon the relationship between the plaintiff and defendant. It is important to immediately identify the relationship between the parties as well as all of the underlying causes for the fall in order to maintain a successful claim for personal injuries as a result of a slip, trip and fall.
